General Terms and Conditions

1. Applicability
These general terms and conditions apply to all offers, quotations, agreements, and services provided by Besteman Marketing, unless explicitly agreed otherwise in writing.
2. Services
Besteman Marketing provides strategic marketing consultancy, AI automation, and creative campaigns for e-commerce businesses. The exact scope of services will be defined in a quotation, contract, or written confirmation.
3. Quotations and Fees

All quotations are valid for 30 days, unless stated otherwise.

Prices are exclusive of VAT and any additional costs, such as advertising budgets, software licenses, or third-party tools.
4. Payment

Invoices must be paid within 14 days of the invoice date.

In the event of late payment, statutory interest and collection costs may be charged.

Besteman Marketing reserves the right to suspend services in case of overdue payments.
5. Client Obligations
The client is responsible for:

Providing all necessary information and materials in a timely manner.

Ensuring the accuracy and completeness of the information provided.

Complying with applicable laws and regulations related to advertising, customer data, and content.
6. Intellectual Property

All materials developed by Besteman Marketing (including but not limited to campaigns, strategies, AI models, copy, and visual assets) remain the property of Besteman Marketing until full payment has been received.

After full payment, the client is granted a non-exclusive right to use the delivered materials.
7. Liability

Besteman Marketing is not liable for indirect damages, including but not limited to loss of profit, reputational damage, or missed business opportunities.

Any liability is limited to the amount paid for the relevant assignment.
8. Duration and Termination

Agreements may be terminated by either party in writing, subject to a notice period of one (1) month, unless agreed otherwise.

Besteman Marketing may terminate the agreement with immediate effect in case of non-payment or breach of these terms and conditions.
9. Force Majeure
In the event of force majeure (including but not limited to illness, technical failures, or government measures), Besteman Marketing is not obliged to fulfill its obligations for the duration of the force majeure situation.
10. Governing Law
All agreements are governed by Dutch law. Any disputes will be submitted exclusively to the competent court in Amsterdam, the Netherlands.
